Consumer Protection Compliance Standard – Stellar Media (Pty) Ltd
In accordance with the relevant sections of the Consumer Protection Act, Stellar Media (Pty) Ltd adheres to the following provisions to ensure fair and transparent interactions with consumers:
A.1) Changes, Deferrals, and Substitution of Goods – Section 46: 1.1) Modifications, deferrals, or waivers of existing agreements do not establish new agreements if executed in compliance with this Act or the existing agreement.
1.2) Substitution of goods post-delivery shifts the transaction to the substituted goods. For written agreements, an amended document will be provided without altering other terms.
A.2) Unfair, Unreasonable, or Unjust Contract Terms – Section 48: 2.1) Supplier must not offer goods/services at unfair or unjust prices/terms. Transaction terms must not unreasonably favor the supplier or impose inequitable obligations on the consumer.
2.2) A term is deemed unfair if it is excessively biased against the consumer, unjustly adverse, or relies on deceptive representation. The consumer’s attention must be drawn to such terms.
A.3) Notice Required for Certain Terms and Conditions – Section 49: 3.1) Notices or provisions aiming to limit liability or impose obligations on consumers must be transparently communicated, allowing full comprehension and consumer assent.
3.2) Consumer agreements must be provided in plain language, detailing financial obligations and the consumer’s awareness of terms.
A.4) Written Consumer Agreements – Section 50: 4.1) Specific categories of consumer agreements may require written documentation.
4.2) In cases of written agreements, the terms must adhere to plain language standards, including an itemized breakdown of financial obligations. A record of non-written transactions is retained.
A.5) Prohibited Transactions, Agreements, Terms, and Conditions – Section 51: 5.1) Transactions or agreements must not contain terms that defeat, mislead, or engage in fraudulent conduct. Supplier may not impose unfair terms that waive consumer rights or violate Act provisions.
5.2) Supplier may not require supplementary agreements with unfair terms, demand instruments or codes, or allow others to do so on their behalf.
5.3) Contravening terms are void, and Section 51 does not limit a supplier’s legitimate use of personal identification codes or numbers for standard business transactions.
